Montblanc Spain Terms of Service

I. Applicable Parties

The Montblanc Spain Terms of Service are formulated and enforced by Montblanc-Simplo GmbH (registered address: Hellgrundweg 100, Hamburg 22525, Germany). These Terms of Use apply to your use of the Montblanc website and mobile applications (collectively, the “Platform”). By accessing and using our Platform, you agree to and accept these Terms of Use; if you do not agree, please immediately cease using the Platform.

II. Changes to the Terms of Use

Montblanc may revise these Terms of Use at any time, and the latest version is always published on the Platform. Any modifications take effect immediately from the date of publication, and your continued use of the Platform constitutes your acceptance of the updated terms.

III. Account Registration and Information Processing

Shopping at the Montblanc Spain online boutique does not require mandatory account registration, but it is recommended that you create an account to enjoy exclusive services and benefits. All personal information you provide is protected by the Montblanc Privacy Policy, which can be viewed on the Platform.

IV. Orders and Payments

Customers placing orders through the Platform or Customer Relations Center are subject to the terms of sale. Spanish consumers have a 14-day right of cancellation under Spanish law, and this right can be exercised for online purchases according to relevant regulations. This right does not apply to customized products or personalized services. After order submission, Montblanc will deduct payment from your payment account upon shipment.

V. Warranty and After-Sales Service

International Warranty: Montblanc provides an international warranty for products within two years from the date of purchase, covering defects in manufacturing and materials. Products returned within the warranty period will be repaired or replaced free of charge by Montblanc for defective parts (shipping costs are the user's responsibility).

Repair Warranty: For completed repair services, Montblanc provides a one-year service warranty from the date of repair completion, covering only replaced parts and completed repair work. Damage caused by improper use is not covered under warranty.

Nib Replacement: Nibs can be replaced free of charge within six weeks of purchase (one year for limited editions), provided the nib is in brand new condition and accompanied by a valid warranty certificate.

VI. Platform Content and Intellectual Property

All materials on the platform (including product images, text, videos, etc.) are protected by copyright, design, trademark laws, and international treaties. You may only download or print platform materials for personal, non-commercial use and may not use them for public or commercial purposes.

VII. Limitation of Liability and Disclaimer

Montblanc does not guarantee the absolute accuracy and completeness of the platform information and is not liable for technical errors in the platform content or differences between product images and the actual product. Platform content is provided "as is" and "as supplied," without any express or implied warranties to the maximum extent permitted by law.

VIII. Applicable Law and Dispute Resolution

These Terms of Use are governed by Spanish law. In the event of a dispute, consumers have the right to seek assistance from the Spanish Consumer Protection Agency (Consumo) or the EU Online Dispute Resolution (ODR) platform.
